New Philadelphia adopted a new Planning and Zoning Code effective October 29, 2024, replacing the prior code. Keeping chickens or other animals is not an enumerated accessory use: Table 1107-1 (Accessory Uses and Structures) lists 19 accessory uses and none cover poultry, fowl, or livestock, while the one agriculture-adjacent entry, Community Gardens, is prohibited (XX) in the R-1 through R-4 residential districts. Under this permissive use-table structure, a use not listed is not permitted, so backyard chickens are not allowed as of right in residential districts. The prior 2-acre / 100-foot carve-out from the old code does not appear in the 2024 rewrite. Residents on non-residential or specially zoned parcels should confirm with the Zoning Office.
